Virginia: Right to Reproductive Freedom Amendment

The Virginia Right to Reproductive Freedom Amendment would amend the state constitution to establish 'the right to make and effectuate one's own decisions about all matters related to one's pregnancy.' The amendment was passed twice by the Virginia General Assembly (2025 and 2026 sessions) as required for referred amendments.

On March 3, 2026, Charla Bansely filed a lawsuit seeking to block the measure, alleging state election officials failed to distribute the amendment to circuit clerks in all counties as required by law.

This is one of four constitutional amendments placed on the November 2026 ballot by the Democrat-controlled legislature.
